Judge Dismisses Challenge to Belleayre Resort Plan
ALBANY (AP): A lawsuit challenging a major Catskill Mountains resort has been dismissed in trial court.
Opponents of a private developer's plan to build a 629-unit resort next to the state-run Belleayre Mountain Ski Center claimed the development deal brokered by former-Gov. Eliot Spitzer is illegal.
State Supreme Court Justice Gerald Connolly dismissed the suit Wednesday, noting that an environmental review is still underway and permits have not been issued. He says the claim is not ready for judicial review and the plaintiffs have not shown they have standing to bring the suit.
The suit was brought by Catskill Heritage Alliance, the Pine Hill Water District Coalition and a couple who live near Belleayre. Their lawyer did not immediately return a phone message Thursday.
